August 2013 Board Meeting Minutes


BOARD MEETING, August 27th, 2013

Call to Order/Roll Call/Affirmation of Quorum

Chairman Evans called the meeting to order at 6:00 p.m. The meeting was held in the Whetstone Fire District station classroom, 2422 N Firehouse Lane, Huachuca City, Arizona.

It was determined a quorum existed with all five board members present.

Special Presentation

Chief Bidon recognized Captain Manning and Engineer Sapienza for going into rising water and rescuing an individual during  one of two swift water rescues. Huachuca City Fire Department assisted by manning safety lines. Captain Manning was presented with a unit citation; Engineer Sapienza will be given a unit citation upon his return from vacation.

Review, Amendment and Possible Approval of Public Session Minutes for July 23rd, 2013

Jerry Hopper stated corrections need to be made to July’s minutes: all five board members should read four board members.
Ken Leffler made the following motion, seconded by Wayne Lewis and approved all in favor none opposed:

Move to accept the public session minutes for July 23rd, 2013 with correction.

Call to the Public

No members of the public wished to address the board.

Review, Discussion, and Possible Approval of the Financial Report

Chief Bidon stated we still have money in the bank and we are doing everything possible to manage spending until taxes come in this October. Signatures from the chairman and clerk are now required on the longer more detailed financial report in accordance with new house bills passed in Arizona that include a forecast two years out from current year.

Wayne Lewis made the following motion, seconded by Ken Leffler and approved all in favor none opposed:

Move to approve the financial report as presented.

Chief’s Report

For the month of July we had 84 calls, 24 were burn calls. The only significant event was the swift water rescue and the unit citations awarded to the crew.

Move to accept the Chief’s Report as presented.

Board Member Comments

Ken Leffler wants to know the status of PBW. Chief Bidon stated he is still trying to arrange a meeting with all parties involved. Ken Leffler also wants to know if the audit has been completed. Chief Bidon stated it is not fiscally responsible to move forward with the audit for information we already know. Ken Leffler asked for clarification on the unpaid taxes. Chief Bidon stated the PBW Fire District residents will be responsible for covering the unpaid payroll taxes if the district is still sound. Once the district is dissolved the IRS cannot go after Whetstone Fire District, the residents of PBW Fire District or Cochise County for the unpaid taxes. Chief Bidon believes the IRS will then subpoena the financial records and look at the individuals involved.

Chief Bidon stated if we absorb PBW Fire District we also absorb their liabilities. Chief Bidon stated if they have not moved on the consolidation in two or three weeks he will present to the board that we null and void. Ken Leffler stated Chief should not wait; Chief Bidon said he will write a letter tomorrow and have Cathy register it.

Wayne Lewis asked the status of our new trucks. Chief Bidon said they will be ready the second week of September.

Rick Evans wants the Sierra Vista Herald to do a story on the unit citations that were presented. Chief Bidon stated he will wait until Engineer Sapienza is back so the Herald can get a picture of both recipients with their awards.

Rick Evans also wants Whetstone Fire and identification on the reports. Chief Bidon said he will fix that tonight.

The Whetstone Fire District Board may vote to go into Executive Session on any agenda item pursuant to ARS 38-431.03(A)(3) for discussion and consultation for legal advise with the governing Board Attorney on the matter(s) as set forth in the agenda item. The order of the Agenda may be altered or changed by order of the Board. Copies of the Agenda are  available upon request at Administration 2422 N. Firehouse Lane Whetstone, AZ. 85616. Call to the Public – According to  the Arizona Open Meeting Law, the District Board can only discuss matters listed on the meeting agenda. At the  conclusion of the open call to the public, individual Board Members may respond to criticism made by those individuals who have addressed the Board, may ask staff to review a matter or may ask that a matter be placed on a future agenda. However the Board will not discuss or take action on any matter rose during a Call to the Public unless the matter has been properly noticed on the agenda. Please step forward or otherwise identify yourself when the Chair announces the item(s) on the agenda which you are interested in addressing.
